Terms of Service

These Terms of Service ("Terms") govern your use of RTOGuard, a Shopify application operated by Impact Marvel ("we", "our", "us"). By installing and using RTOGuard, you agree to these Terms.

1. Service description

RTOGuard is an AI-powered RTO (return to origin) prevention tool for Shopify stores. It gives each Cash on Delivery order a risk score, tags the order in Shopify, can ask the buyer to confirm the order on WhatsApp from your own WhatsApp Business number (coming soon), and reports sales kept after cancellations and returns, including per ad from the tracking tags on the order. Actions such as cancelling an order happen only when you turn them on or choose them.

2. Account and access

  • You must have an active Shopify store to use RTOGuard.
  • You authorize RTOGuard to access your store's order, customer and product data via Shopify's API.
  • You are responsible for maintaining the security of your Shopify account.
  • You must be authorized to accept these Terms on behalf of your business.

3. Plans and billing

  • Free: 100 COD orders a month, no charge.
  • Starter: US$19.99 a month for 1,000 COD orders a month.
  • Prepaid orders are never counted. Prices are billed in US dollars on your Shopify invoice.
  • WhatsApp features are coming soon and are not part of any plan yet. When they are live, WhatsApp message fees are charged by Meta directly to your own WhatsApp Business account and are not part of RTOGuard billing.

Billing is handled through Shopify's billing system. You approve every charge on Shopify's own page. You can switch to Free at any time in RTOGuard (Plans and usage, Switch to Free); the paid plan ends at once. Refunds follow Shopify's standard policy for app charges. See the refund policy.

4. Service limitations

  • RTOGuard provides risk predictions, not guarantees. No scoring system is 100% accurate.
  • We are not liable for orders that are incorrectly flagged, held or approved based on the risk score.
  • The machine learning model's accuracy depends on the volume and quality of delivery feedback you provide.
  • WhatsApp message delivery depends on Meta's WhatsApp Cloud API, template approval and the buyer's phone connectivity.
  • We recommend running in test mode for the first week to calibrate thresholds before taking live actions.

5. Your responsibilities

  • Set appropriate risk thresholds for your store's needs.
  • Review held and no-reply orders before you ship or cancel them.
  • Provide delivery feedback (mark orders as Delivered or RTO) to improve ML accuracy.
  • Comply with applicable laws regarding order cancellation and customer communication.
  • Tell buyers in your store policies that COD orders may be confirmed on WhatsApp.
  • Enter your ad spend accurately if you use the ROAS reports; RTOGuard does not read or change your ad accounts.

6. Intellectual property

RTOGuard, its scoring algorithms, machine learning models and user interface are the intellectual property of Impact Marvel. You may not reverse engineer, copy or redistribute any part of the application.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMPACT MARVEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, LOSS OF PROFITS OR LOSS OF DATA, ARISING FROM YOUR USE OF RTOGUARD.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination

You may uninstall RTOGuard at any time through your Shopify admin. We may terminate or suspend your access if you violate these Terms. Upon termination, your data will be handled as described in our Privacy Policy.

9. Changes to terms

We may update these Terms from time to time. We will notify you of material changes via email or through the RTOGuard dashboard. Continued use after changes constitutes acceptance.

10. Governing law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of Bhopal, Madhya Pradesh, India.

11. RTOGuard network (optional; draft pending legal review)

The RTOGuard network is optional and off unless you join it. If you join:

  • For each Cash on Delivery order, RTOGuard stores a keyed one-way hash of the buyer's phone number (HMAC-SHA256). The phone number itself is never shared.
  • When scoring an order, RTOGuard checks whether that hash had delivered or returned orders at other stores in the network and gives you only a band: low, medium or high. You never see another store's identity, orders, values or buyer details, and other stores never see yours.
  • The band is shown to you on the order as context only. It does not change the risk score, the risk level or any action, and RTOGuard never blocks, cancels or refuses an order because of it.
  • You agree to tell your buyers in your privacy notice that order details may be checked against delivery history to reduce failed deliveries. RTOGuard provides suggested wording in Settings.
  • You can leave at any time in Settings. On leaving, your store's hashes are deleted and your orders are no longer matched.
  • Under the Digital Personal Data Protection Act, 2023, your store remains the data fiduciary for your buyers' data; RTOGuard processes it on your behalf for this purpose only.

12. Data processing

This section is the data processing agreement between you (the merchant) and Impact Marvel (RTOGuard). It applies to personal data of your buyers that RTOGuard processes for you. The full text, with sub-processors and deletion details, is on the data processing page and forms part of these Terms.
